Abstract
This artile describes the process related to the public action of unconstitutionality against article 88 of the Code of Criminal Procedure (Restitution of Property), which culminated with the sentence C-591 of 2014 (Colombian Constitutional Court). Likewise, the document attempts to develop a pedagogical strategy based on (i) the constitutionalization of the criminal process, and (ii) the application of legal concepts that go beyond the formalism of the legal norms.
